1. Definitions
- “Paltics,” “we,” “us,” “our”: refers to PALTICS HEALTHTECH PRIVATE LIMITED, its directors, and authorized representatives.
- “App” or “Platform”: refers to the Paltics mobile application and web-based system providing patient data storage, analytics, and communication tools for healthcare professionals.
- “User” or “you”: means any individual who accesses or uses the platform.
- “Healthcare Professional” or “Provider”: means a licensed doctor, physiotherapist, or health practitioner using Paltics for professional purposes.
- “Patient Data”: means clinical or personal data about a patient entered by a healthcare professional.
- “Personal Data”: means information that can identify an individual (such as name, email, phone number).
2. Acceptance of Terms
By downloading, installing, or using the Paltics App or accessing any of our services, you agree to be bound by these Terms of Use and our Privacy Policy.
If you do not agree, you must not use the platform.
You represent that:
- You are 18 years or older; and
- You are a licensed healthcare professional if using it for clinical purposes.
3. Modification of Terms
- Paltics reserves the right to modify, update, or revise these Terms and the Privacy Policy at any time.
- Users will be notified via in-app notice or email before changes take effect.
- Continued use after such notice constitutes acceptance of the updated terms.
4. Account Registration & Security
- You must provide accurate information during registration.
- You are responsible for maintaining confidentiality of your login credentials.
- You must immediately notify us of any unauthorized use of your account.
- Paltics is not liable for any loss or damage arising from your failure to secure your credentials.
5. Use of Services
Users agree to:
- Use Paltics only for lawful medical record and analytics purposes.
- Obtain appropriate patient consent before entering identifiable patient data.
- Not upload or transmit viruses, spam, or any content violating applicable laws.
We may suspend or terminate access for policy violations, illegal activity, or misuse of patient data.
6. Intellectual Property
- All software, code, graphics, design, and trademarks associated with Paltics are the exclusive property of PALTICS HEALTHTECH PRIVATE LIMITED.
- You are granted a limited, non-transferable license to use the app solely for its intended purpose.
- Reverse engineering, copying, or redistribution is prohibited.
7. Data Ownership
- The data you enter (including patient data) remains your property.
- Paltics only processes such data to provide and improve its services.
- Aggregated or anonymized data may be used for analytics, quality improvement, or research.
8. Payment & Subscriptions (If Applicable)
If you subscribe to paid features, you agree to:
- Pay applicable fees through Apple App Store or approved methods.
- Understand that Apple manages billing and refunds for in-app purchases.
- Cancel subscriptions via your App Store account settings.
9. Warranty Disclaimer
- The Paltics app is provided “as is” and “as available.”
- We make no warranties regarding uninterrupted service, accuracy, or fitness for a particular purpose.
- We are not responsible for clinical decisions made using the platform.
10. Limitation Of Liability
To the fullest extent permitted by law, Paltics shall not be liable for:
- Indirect or consequential damages (loss of profits, data, etc.);
- Errors or data loss due to user negligence;
- Breaches caused by third-party systems.
Total liability shall not exceed the fees paid by you in the preceding 12 months.
11. Indemnification
You agree to indemnify and hold harmless Paltics, its officers, and affiliates against any claims, losses, or damages arising from:
- Violation of these terms;
- Unauthorized or unlawful entry of patient data;
- Misuse of the platform.
12. Termination
We reserve the right to suspend or terminate access at any time for policy violations or misuse.
Upon termination, your account and data may be deleted or anonymized as per the data retention policy.
13. Governing Law & Jurisdiction
- These Terms are governed by the laws of India.
- Disputes shall fall under the exclusive jurisdiction of courts in Siliguri, West Bengal.
14. Standard Legal Clauses
- Severability: If any clause is invalid, the remaining terms remain enforceable.
- Entire Agreement: These Terms and Privacy Policy constitute the entire agreement.
- Waiver: Failure to enforce a provision does not constitute waiver.
